Amount of the allowance
Your employer pays you an allowance corresponding to 60% of your gross salary for each eligible hour not worked, or approximately 72% of your hourly net salary.
The allowance cannot be less than €9.74 or more than €33.24 per hour not worked.
The compensated hours are the hours not worked, up to the statutory working time limit or, if it is shorter, the collective or contractual working time. Overtime hours that are not provided for in your employment contract or by a collective agreement are not compensated.
If you are on an apprenticeship or professionalization contract and your remuneration is lower than the Smic, your hourly allowance corresponds to the percentage of the Smic or to the applicable collective agreement provisions.
A collective agreement or arrangement, as well as a unilateral decision by your employer, may provide for additional compensation.
Payment and information on the payslip
Your employer pays you the allowance on the usual salary payment date.
In the event of safeguard, receivership or judicial liquidation proceedings, the Agency for Services and Payment may pay the amount directly to you following a decision by the prefect.
The number of compensated hours, the rates applied and the amounts paid must appear on your payslip or in an attached document.
