TLDR: Dividends distributed by an OPCVM (such as a FCP) are income from movable capital. Managers withhold and remit the withholding tax (Art. 119 bis CGI) and declare the amounts allocated to each unit holder.
Nature of OPCVM dividends
The sums or values distributed by an OPCVM constitute income from movable capital for unit holders as of the distribution date. This classification applies except in cases provided for by law (e.g., distributions mentioned in Articles 7 and 7 bis of II of Article 150-0 A of the CGI).
Obligations of OPCVM managers
Managers of mutual funds are required to:
- Withhold and remit to the Treasury the withholding tax provided for in Article 119 bis of the CGI, as well as the withholdings under Articles 117 quater and 125 A, proportionally to each unit holder's share.
- Declare the sums or values allocated to each unit holder, in accordance with the obligations set by decree.
Declaration by the unit holder
OPCVM dividends constitute income from movable capital.
